Fraud: Court convicts senior Lawyer for criminal breach of trust & cheating

criminal breach of trust.A senior lawyer of the Borno State branch of the Nigerian Bar association (NBA), Ahmed Mai-Aji, has been jailed by a Maiduguri court for Criminal breach of trust.

The convicted lawyer whose case was first taken before Justice Umar Fadawu by the Economic and Financial Crimes Commission EFCC and later transferred to the Chief judge Kashim Zannah was later sent to justice Haruna Mshelia who gave Thursday’s conviction.

Ahmed Mai-aji was re-arraigned on a-three count charge before Justice Haruna Mshelia of the High Court Maiduguri,  for the offences of Criminal breach of trust and cheating to the tune of Three Million Naira.

The accused person who is a senior lawyer in the bar was entrusted with a land document for the purpose of intervening in a land dispute between the complainant and another party but he dishonestly disposed that person of that plot in violation of the trust the complainant had for him.

While the case lingered before justice Fadawu and due to reasons are best known to him, Mai-aji was re-arraigned as a result of an application brought by his counsel barrister Konto seeking an order declining jurisdiction to hear and determine the charge on the ground of bias or likelihood of bias by the judge.

In his ruling on 16th May 2017, Justice Fadau said, “the issue of bias arises as a result of judicial rulings delivered by this court on the grounds of the application brought by the defence counsel for lack of jurisdiction by the EFCC to initiate any criminal matter before this court and the refusal of bail.

“The Registrar of the court should return the case file to the Chief Judge of the State and I hereby decline jurisdiction not to hear the case. The accused be further remanded in the prison custody.�

On Tuesday, June 13, 2017, Mai-aji was re-arraigned by the Economic and Financial Crimes Commission, EFCC before justice Mshelia.

Prosecution counsel Khalid Sanusi in proving the case tendered seven different exhibits and five witnesses who testified against the convict.

In his judgment, Justice Mshelia stated, that “the court hereby found you guilty of the offences of criminal breach of trust and cheating.�

Count Three of the Charge read: “That you, Ahmed Mai-Aji sometimes in 2016 at Maiduguri Borno State within the jurisdiction of this Honourable Court, dishonestly induced one Baba Bukar to deliver to you the sum of N3m in the name of payment for a Plot of land situated at Pompamari Light Industrial Layout, Maiduguri Borno State, covered by grant of Right of occupancy N0:BO/6057 of 79.1981, which was kept in your custody for the purpose of discharging your responsibility without any right to sell same, contrary to and punishable under sections 320 and 321 of Penal Code Law Cap 102, Laws of the Borno State of Nigeria 1994 respectively.â€�

While sentencing Mai-aji on count one, he said, “the court sentenced you to five years in prison without an option of fine. And equally found you not guilty and therefore, discharged and acquainted you on count two.�

“The court found you guilty and convicted you to two years in prison without an option of the fine and the sentence to run concurrently.� On the second count.

Owerri – Amidst the raging controversy trailing the governorship ticket of the All Progressives Congress (APC), Imo State Governor Rochas Okorocha has insisted that Senator Hope Uzodinma is not a member of the party in the state.

He said that Uzodinma’s purported membership of the party was announced in Abuja and that he had never attended any meeting of the party in his ward, local government (Oru East) or at the state level.

This, he said, was the reason no APC member in the state was excited when the party’s National Chairman- Comrade Adams Oshiomhole announced him as his preferred governorship candidate of the party in the state.

“APC members in Imo State see Chief Uzodinma as still a staunch member of the PDP and that was the reason behind the dead silence in Imo over the announcement of his name as the governorship candidate of the party.

“If Chief Uzodinma was to be a known member of the party, there would have been celebration in Imo and the Chieftains of the party in Abuja backing him are elite politicians who have no relationship with the grassroots.�

 The governor who spoke through his Chief Press Secretary, Sam Onwuemeodo, recalled that he won his election in 2011 on the platform of the All Progressive Grand Alliance (APGA) through the ballot box and repeated the feat in 2015 on the ticket of the APC when the two parties were not in power at the federal level.

“So he did not enjoy any federal might as Imo people voted for him for who he is,� stressing that the case of Uzodinma was different as he (Uzodinma) in 2011 took the senate seat for the Imo West (Orlu Zone) from Chief Osita Izunaso through the court.

The Governor urged Uzodinma to face charges of issuance of dud cheques and non-declaration of assets still hanging on his neck saying “since Chief Uzodinma had begun to throw stone not considering the fact that he lives in a badly constructed glass house, we challenge him to publish his profile for the public to see and let Rochas also publish his own.�

2019: 41 candidates jostle to become Lagos governor, 589 eye Lagos Assembly

The INEC in Lagos State on Friday published details of 41 candidates of various political parties in the state for the 2019 elections jostling to become Governor.

A check by a NAN Correspondent at INEC office in Lagos revealed that 589 candidates of different parties are also eying 40 seats in the Lagos State House of Assembly.

NAN reports that the INEC timetable and schedule of activities for the 2019 general elections indicated that publication of personal particulars of candidates (CF001) for the governorship and state Houses of Assembly elections would be made on Nov. 9.

Section 31(3) of the Electoral Act, 2010 (as amended), provides that the publication must be made within seven days of the receipt of the form from political parties at the constituency where the candidate intends to contest the election.

The publication on Friday indicated that 41 political parties out of 62 in the state would contest the governorship election while 47 would participate in that of the state house of assembly.

NAN reports that only APC, PDP, SDP, ADC, AD and MPN fielded candidates for all the 40 seats in the state parliament.

Political parties that fielded candidates in at least 20 of the 40 state constituencies for the house of assembly election are: ADP (34) , ACCORD (28), NCP (23), PPC (21), ANP(20), PPN (20), LP (32) and PT (20)

Speaking to NAN on the development, Mr Femi Akinbiyi, the Lagos INEC Public Relations Officer, said the commission had fulfilled the requirements of Section 31(1 and 3) of the Electoral Act, 2010 (as amended) with the publication.

Akinbiyi said that the list of political parties and the particulars of candidates participating in house of assembly election had been published in the Local Government Offices of INEC in the various constituencies.

“With this publication now, the commission is set for 2019 elections.

“We enjoin eligible voters who are yet to pick up their Permanent Voter Cards (PVCs) to do so before it will be too late.

� Now, following the ongoing display of voters register across the 8462 polling units in the state, those PVCs have been moved to all the wards in each local government to bring it closer to the people for collection.

“Not minding the fact that the period for claims and objections during this period of display of voters register ends on Nov. 12, the commission has extended by one week the opportunity to distribute PVCs at the ward level,� he said.

Falz Files Lawsuit Against NBC For Placing A Ban On His Viral Song ‘This Is Nigeira’

Nigerian rapper and actor, Folarin Falana, popularly known as Falz The Bahd Guy, has lived up to his vow as he’s filed a lawsuit challenging the ban placed by the National Broadcasting Commission (NBC) on his song, “This is Nigeria”.

Court documents were filed on behalf of the rapper by his lawyers, Adepetun Caxton-Martins Agbor & Segun (ACAS-Law), on November 6, 2018, three months after the commission fined JODAJ Global Communications Limited in Jos for playing the record, before proceeding to ban it along with other songs.

In the letter sent to JODAJ Global Communications Limited, the commission stated that its reason for banning the son was because the lyrics are vulgar and in contravention of the NBC Code.

Many Nigerians online including celebrities and fans of the rapper criticized NBC for the ban, stating it was unfair and that the song contained no vulgar language but spoke about the situation in the country.

Falz had previously hinted during an interview in August that he would write to the NBC to know their reason for the ban and if necessary, seek legal redress in the courts.

The Originating Summons reveals that Falz is seeking, among other things, for:

1. A declaration that the Defendant’s prohibition of the Plaintiff’s song titled “This Is Nigeria” from being aired by the Nigerian media outfits on the pretext that same is laced with vulgar lyrics is in flagrant breach of the Plaintiff’s  right to the freedom of thought, conscience and expression as guaranteed under Sections 38 and 39 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and to that extent, such prohibition is unconstitutional, null and void.

2. An Order of this Honourable Court setting aside and/or vacating the decision of the Defendant as contained in the letter dated 6th August 2018 and lifting the ban or proscription of the use of the Plaintiff’s song titled, “This Is Nigeria” by any and all Nigerian media outfit/organizations.

3. The sum of N100,000,000 (One Hundred Million Naira to the Plaintiff on the footing of aggravated and exemplary damages for the wrongful and unconstitutional acts of the Defendant.

Unproductive Youths: Nigeria’s Time Bomb -Chukwumerije

Oghara – Mr Dike Chukwumerije on Friday warned that Nigeria was “a country full of dependent adultsâ€� and is therefore “in great troubleâ€� and that is why one in every three Nigerian is thinking of fleeing from the country.

He said Nigeria can neither thrive nor be peaceful when old animosities are being inherited and multiplied by the new generations.

He then called for a new dawn that will unfold the day of the Nigerian youth in a lecture titled; “The Youth and the Future of Nigeria: The Paradox of Assets and Liabilities�.

Delivering the Convocation Lecture at the 10th Anniversary of the Western Delta University (WDU), Oghara, on Friday, Chukwumerije explained in detail, how this could come about.

First, the youths, he said, must aim at achieving economic freedom and not depend on others beyond their school years or they can never achieve their full potentials.

So, he admonished the WDU graduands: “This is your primary challenge as you go into the society, how to develop the capacity to pay for your own food, to pay for your own rent, and to pay for your own life.

“You must either get a job that allows you to live fully, or you must create a business that allows you to live fully. Without economic freedom, you will be a pawn in the games of others. You must have an ability that can earn you a living�.

He asked the youths to be creative, pursue their dreams develop their natural abilities to gain economic freedom. He cited the example of himself; saying he studied law, but is earning a living through poetry, writing and motivational speaking – things people had advised him would never be lucrative.

Second, he said that the Nigerian youths need “Freedom of Thought� that would free them from the old poisonous ways of thinking; tribalism, nepotism, procedural dogmatism, and religious extremism.

“The belief that my God is right and your God is wrong, that my people are right and your people are wrong. You must free yourself from these inflexible positions, and develop the capacity to be open, and to see the world through fresh eyes. Form the habit of examining old problems in a new ways. Above all, cultivate empathy for others.�

Third, Chukwumerije challenged the youths to aim at “Political Freedom�, and fight to enthrone it in Nigeria. He said that without it, citizens cannot vote according to their consciences, and so cannot vote for those that would lead people in the right direction, because bad governance is a direct result of lack of political freedom.

“Without political freedom, Nigeria will remain the graveyard for youths where youths will be perpetually trapped in the category of dependent adults.�

Turning to the government, he said good governance must flourish, and provide a level playing field for all youths to enhance their abilities, make an impact by changing Nigeria and the world.

“Youths can be a powerful force for good in the society. But to achieve this it is important to populate their minds with progressive ideas, and to provide them with dignifying economic opportunities that engage them fully and sustain them at a decent level of living.

“Without these, youths will be a destructive force in society. While we wait on government to realize this and do what good government does, we can take steps as individuals to emancipate ourselves from mental slavery and from economic dependence, so that we can have the unrestricted capacity, in our own little corners, to be shining beacons of hope and faith to those around us.â€�

He said: “If all articulated is done, and the youths begin to “see Nigeria and the world in a new light and not be weighed down by the ethnic, baggage inherited from the older generation, then you will find the sun rising steadily over a new day; over the Day of the Nigerian Youth.�

How Societal Norms Hinder Formal Education For Boys, Girls In Northern Nigerian

Abuja – Indoctrination goes a long way in determining the personality of an individual because parents and families have the most direct and lasting impact on children’s learning and development.

As the first educators of their children, parents play a crucial role in their children’s educational journey. Whatever they inculcate in them, it becomes their way of life.

No wonder children, especially those from the northern part of Nigeria detest western education with a passion. They are made to believe that western education is for non-Muslims and it is sinful, which is the very meaning of the word, “Boko Haram”, which has now gone from being a mentality to a terrorist organisation.

It’s pertinent to define education: “Education is a systematic process through which a child or an adult acquire knowledge, experience, skill and sound attitude geared towards making an individual civilised, refined, cultured and educated.â€�

Meanwhile, Islamic education as presented by Islamic scholars, is not merely a creed, it is a way of life and a life to be lived. It is religion that is adherent to acquisition of knowledge of any sort whether art, science, technology or theology.

However, many children from the northern part of the country don’t see anything good in formal education because of the knowledge their parents have inculcated in them.

Sampling opinion of some of the Almajiri boys on the streets of Kano on whether they will like to get off the streets and learn in the four walls of the classroom, Ibrahim Sodiq, an 11 years old boy, said through an interpreter that he cannot and will never go to school. “I go to Arabic school and there is no need for western education; its a sin.�

According to him, “I am not from Kano, I came from Katsina state, I go to Arabic school in the morning and in the afternoon I go out to ask for alms and look for food to eat and the following day I start my day again.”

Similarly, Abubakar Abdullahi, 12, who also spoke through an interpreter, said nothing good can come out of western education as it is a sin and is against Islam.

According to him, “I will not go to school for any reason, even if I am offered scholarship to school for free,â€� adding that free education cannot lure him to go to school, “because it is a sin and I cannot be involved in it.”

Also speaking through an interpreter, 14-year-old Muhammed Dogo, said that he prefers Arabic education to formal education because it is a way of life. He also said many of the children prefer it, “We all meet in Arabic school and when we depart we go our different directions seeking for alms.

“Most of us are not from Kano; our parents brought us here to learn Arabic. We sleep in the mosque and whatever we make from our begging we use to start small businesses like selling pure water and other little things to make a living. I’m happy with the way I am living because it is in line with the tenet of my religion.�

Meanwhile, a middle-aged man, Mr. Abubakar Jubri, said: “I am a northern and a devoted Muslim. Even though I attended Arabic school, my parents also enrolled me in school and today, I’m a university graduate and gainfully employed. This is what I wish for my children too.

“Until parents begin to see reasons to train their children in both Arabic and formal education, the number of out of school children will continue to increase.

He regretted that most parents transport their children to other states of the country for Arabic education at age four or five and that these children are left on their own to hustle and fend for themselves.

They don’t expect that children back home for years and they don’t show them any parental love and will expect them to bring something home.

He, however, opined that if those children at that age are sent to school, they will grow up to known the benefit of education and in turn fulfill their potential and become great personalities in life and this will be a kind of generational cycle because the educated parents will want their children educated.

Contrary to Mr Jubril’s response on why they allow their children to grow up in the street as beggars, Mrs Silifatu Ibrahim, who also spoke through an interpreter, said it has been like that before she was born and “will continue to be because its our tradition. We belief in Arabic education for our children, when they graduate we celebrate them. It brings joy to the parents.

According to her, “When a child (boy) is about four years old, the father will take him to another state for Arabic education, this children are accommodated by their teachers or in the mosques but they go out to fend for themselves.

Speaking on why the gap exists, UNICEF, Communication Specialist, Mr Geoffrey Njoku, said the demand issues are rooted in the socio-cultural and economy such as early marriage and gender norms in many parts of Nigeria.

Mr Njoku further hinted that, social norms, some cultural practices, beliefs keep children out of school and deny them the right to education and grow into their full potentials.

According to him, gender norms keep many girls out of school. The traditional low value placed on female education is rooted in gender roles where the expectation is that girls will grow and end up in the kitchen of their husbands, so there is no need to educate her.

Buttressing Njoku’s assertions, Mrs Azuka Menkiti, UNICEF Education Specialist, while speaking on the topic: “Gaps in Education Access in Nigeria: A Situation Analysis and what UNICEF is Doing”, said in northern Nigeria, “It is widely believed that a girl is supposed to see her first mensuration in her husband’s house. Thus these girls are married off between the ages of 10 and 11.

“Similarly, most girls who are privileged to go to school find it extremely difficult to compete favourably well with their male counterparts.

“These girls are meant to do the household chores before and after school with little or no time for reading or doing her assignments.

“When she gets to school the teacher may scold her for not doing her homework and the poor girl within a minute recalls all the house chores she does before and after school hours and teacher did not give her any benefit of doubt to explain herself. She broke into tears and gradually began to lose interest in education.�

Mrs Menkiti however opined that early marriages are still a common traditional practice which negatively impacts on girls’ enrollment and retention in school.

She added that, parents have naturally shared roles that sound like this: girls are to fetch water, cook, do the laundry, sweep, watch plates and all that. What does the boy do? After all its a man’s world, they will say. If the girl will remain in school, all these must be addressed.
