Justice Okoroafor, while ruling on the issue of transfer of the case from his court to another high court at Osisioma without due process, said that he could not transfer a matter to another court without the case file.
The case in question had been before Justice Okoroafor when the stateâ€s acting Chief Judge, Justice Kalu Ogwe, allegedly in connivance with the Chief Registrar, Benson Anya, removed the case file without the knowledge of the presiding judge.
Justice Okoroafor, in his ruling, said that the case was still before him and had not been transferred to another court, adding that anyone saying otherwise was merely misleading the public.
He maintained that no judge worth his office would transfer a case without the case file of the matter before him and wondered what the judge would write on the transfer papers, stressing that due process must be followed before a case will be transferred.
The judge recalled that he had earlier made an order asking the chief registrar, who took away the case file of a matter that has been pending at his court without his knowledge, to return the case file before October 18, which he never did.
The judge, who expressed worry that the registrar disobeyed his court order, wondered what judicial system was turning into in the state, adding that he was surprised to receive a statement asking him to hands off the case by the CJ without due process.
The judge, who has been sitting with the full complements of all security apparatus in the state since the court was invaded by hoodlums, allegedly sponsored by the sacked Donatus Nwankpa faction, said that the case would remain adjourned till the case file is returned.
