Delta APC Crisis: Oshiomole, INEC Chairman  Risk Jail Term

ABUJA – The political feud rocking the Delta state chapter of the All Progressives Congress (APC), has assumed another dimension following the filing of a contempt charge against the National Chairman of the APC, Adams Oshiomole and the Chairman of the Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu.
The contempt proceeding filed by aggrieved chieftains of APC at the Federal High Court Abuja was sequel to the alleged disobedience of a court order by the APC and INEC.
Oshiomhole and Yakubu were alleged to have disobeyed the order of court in the  suit marked FHC/ASB/CS/76/2018, filed by the Chief Cyril Ogodo led exco of the APC in Delta state.
In the said court order in reference dated October 17, 2018 and signed by the Registrar of the court, Ejike Onwukobu, Justice T. B. Adegoke, sitting in Asaba division of the Court had while  adjourning the case ordered parties to maintain status quo by not taking any further steps that could destroy the res in the case.
In spite of the above order of court, the National Chairman of the APC, Oshiomole still went ahead to submit names of purported National Assembly candidates from Delta APC to INEC and the Commission  also went ahead to receive and publish such names.
The Ogodo  faction instituted the suit against  the APC, Oshiomhole, INEC and Prophet  Erue  over the issue of the authentic list of  candidates that emerged from the parallel primaries conducted in the state by the two contending state executives of the party in Delta State.
The primary conducted by the Ogodo led exco produced Prof Pat Utomi and Olorogun O’tega Emerhor as Governorship and Senatorial candidates respectively while that of Prophet Jones Erue produced Chief Great Ogboru and Senator Ovie Omo-Agege as Governorship and Senatorial candidates respectively.
Meanwhile, a notice of consequence of disobedience to a valid  court order contained in Form 48 has been issued  on Oshiomhole and Yakubu.
Other defendants in the contempt proceedings are the All Progressives Congress; members of the National Working Committee (NWC) of the party and Prophet Jones Erue, factional Chairman of the Delta state chapter of APC.
While Oshiomole is cited for contempt for submitting list of National Assembly candidates for Delta state to INEC against a subsisting order of court, Prof. Yakubu ‎is alleged to be in contempt for accepting and publishing such names.
In a statement on Sunday, counsel to the plaintiffs, Chief Mike Ozekhome, (SAN) said his clients have commenced contempt proceedings against the defendants by filling before the court, Form 48 which is  ‘Notice of Consequence of disobedience to order of Court.’
The said Form 48 dated November 1, 2018 simply reads: “Take notice that unless you obey the direction contained in this order, you will be guilty of contempt of court and you will be liable to be committed to prison”.
The statement  called on the ruling APC “to deviate from the bad precedence, already set for so far, by the government which is notorious for disobeying court orders, at least, to regain the battered and shattered confidence of Nigerians.
It equally called on the judiciary to rise up in defence of its jurisdiction and the rule of law, “as it can no longer hold itself out as a toothless bulldog that can only bark but cannot bite.”

Rooney to make England farewell against USA

Wayne Rooney is to come out of England retirement for a final one-off appearance against the United States in an international friendly at Wembley this month, the Football Association announced Sunday.

Rooney, a record goalscorer for both Manchester United and England, has not played international football for nearly two years.

But the 33-year-old, now based in the United States where he plays for Major League Soccer side DC United in Washington, will wear the Three Lions shirt one last time for the Wembley fixture on November 15.

The match will be called The Wayne Rooney Foundation International in support of the striker’s charity aiding disadvantaged children, with England manager Gareth Southgate naming the 33-year-old in his squad.

“I am truly humbled and hugely excited to play for England at Wembley again,” said Rooney in a statement issued by the FA that billed the game as his “final England appearance”.

“I would like to thank Gareth Southgate and The FA for inviting me back and helping to support my Foundation in the process.”

The FA added the match would give the Wembley crowd the “chance to show their appreciation of one of England’s greats as the curtain comes down on a glittering Three Lions career that spanned three FIFA World Cups and three UEFA European Championships”.

Former Everton and United forward Rooney scored 53 goals in 119 England appearances — the most by any outfield player — prior to announcing his retirement from international football in August 2017.

He has scored 12 times for DC United since he joined them after the end of the last English season, following a second spell at boyhood club Everton, and helped them climb from the bottom of the league ladder to the play-offs.

StrikeAS the Nigeria Labour Congress (NLC) prepare for its planned November 6 nationwide indefinite strike on account of the inability of the government of the federation to accept payment of N30,000 new national minimum wage, the Senator representing Anambra-central senatorial district at the Red Chambers Abuja, Senator Victor Umeh has said that the federal government’s option for a court order to stop the strike will not resolve the issue, instead it will further aggravate the situation.

Umeh stated this at the Awka-South local government headquarter over the weekend during an Award ceremony organize by the Transition Chairman of the council, Hon Leo Nwoba in honour of Obiano’s wife Chief Mrs Ebelechukwu Obiano for her outstanding performance in the state while responding to questions from newsmen on the planned industrial action by labour from November 6, 2018.

He said that the federal government should not bluff workers when dealing with them, pointing out that even if the federal government got a court order to stop labour from embarking on strike, workers must go on strike to press home demands for better working conditions and welfare packages.

The Senator opined that the federal government should engage labour in a meaningful dialogue and that the only dialogue was for the FG to consider the money workers were demanding and whether in all sincerity a Nigerian worker could run a home with N22,500 salary per month as proposed by governors.

He also stressed that Nigerian workers did not have a living wage and that the federal government should no longer pretend that there was no money when a lot of people were living in affluence while workers languished in abject poverty.

The Senator said, what Nigerian workers deserve is a living wage, not the N30,000 they were currently agitating for emphasising that “there is nobody in his employ that earns below N40,000 a month. Many people earn N70,000, N50,000, N100,000 and above, so I don’t know why the government is very adamant in the plight of workers. The governors that are saying that they will pay workers N22,500; how can a worker use N22,500 a month to look after his or her family?�

Umeh stressed, “I work in the Senate and I know that there’s money we appropriated in the budget; this year alone over N9 trillion was in the budget and N500 billion was dedicated to special projects to fight poverty. Where is the money?

“They said they spent about N24 billion every month; I am from Anambra state and I have not seen where the money was applied. Government should learn how to manage their resources and pay workers the money they are asking for. My gateman earns about N35,000 every month even cleaners. So why should the government say a man with about seven children should go home with N22,500 a month?�

He maintained that government should know that it was not only those in leadership positions that should have access to the nation’s treasury and that N30,000 can’t solve problems in homes. He urged leaders to cut down on excess expenditures for the interest of all.

Minimum Wage: Aviation Unions Join Organised Labour To Shut Down Airspace

As the nation prepares for a joint indefinite strike by Nigeria Labour Congress (NLC), Trade Union Congress (TUC) and the United Labour Congress (ULC), unions in the aviation industry have backed the parent bodies by threatening to shut down the airspace from 12am on November 6.

The indefinite strike to press home the demands of the workers commences on November 6, 2018 nationwide.

The unions are asking for wage increase from the current N18,000 minimum wage to N30, 000, but the Federal and State Governments are proposing N24,000 monthly minimum wage for the workers.

The unions in a jointly signed notice dated November 3, 2018 and made available to journalists said that they decided to join the action following the unwillingness of the government to implement the report of the tripartite committee on minimum wage review.

The notice was jointly signed by four secretaries of the industry unions; National Union of Air Transport Employees (NUATE), Air Transport Services Senior Staff Association of Nigeria (ATSSSAN), National Association of Aircraft Pilots and Engineers (NAAPE) and the Association of Nigeria Aviation Professionals (ANAP), Comrades Temenu Akinola, Frances Akinjole, Ocheme Aba and Abdulrasaq Saidu, respectively.

The unions emphasised that the notice also applied to all businesses and agencies involved with aviation to be aware of the above situation and adjust their businesses accordingly, stressing that it would ensure that activities in the sector are grounded to a halt.

The letter reads in part: “In complying with the directive of the labour centres, therefore, we issue this notice to all workers in the aviation sector to withdraw all services from 00:00hrs of November 6, 2018.

“The notice also applies to all businesses and agencies involved with aviation to be aware of the above situation and adjust business accordingly. The general public, especially the international travelling public, are equally notified to avoid, or cancel, plans to utilise av workers in the aviation sector to withdraw all services within the period of the strike.

“For emphasis, all workers must comply with this directive as our unions will not tolerate any sabotage of the strike.�

APC state chairmen, Govs, Senators allegedly plotting to remove Oshiomhole

Oshiomhole incurred the wrath of some state Governors and other members of the ruling party following the outcome of the just concluded party primaries across the country.

There  are unconfirmed reports that all the chairmen of the All Progressives Congress (APC) in the 36 states of the federation are plotting to remove the party’s chairman, Adams Oshiomhole.

Punch reports that the state chairmen have been meeting in Abuja since last week to discuss about the issue.

A source however revealed that the National leader of the APC, Bola Tinubu will not let it happen.

The source said “Tinubu does not want Oshiomhole removed; so, he too is moving up and down to protect him (Oshiomhole). One of his moves is his private visit to the President recently.

“This may stop the plot of the chairmen because his visit to the President was not unconnected with the Oshiomhole issue.�

Tinubu meets Buhari

Tinubu was in the Presidential Villa twice in the past week to meet with President Buhari.

After his first visit, the APC National Leader openly declared support for Oshiomhole’s style of leadership.

Tinubu also told newsmen that the APC chairman cannot be removed because he has not violated the party’s constitution.

Governors and Senators vs Oshiomhole

According to Punch, some aggrieved Governors are also working on getting the support of Senators who lost out in the primaries to throw Oshiomhole out.

The APC chairman has been openly antagonized by some Governors, notably Rochas Okorocha of Imo, Ibikunle Amosun of Ogun, Rotimi Akeredolu of Ondo over his handling of the primaries.

Oshimhole's reaction

Oshiomhole in his reaction, said that he will not sell his conscience to keep his job.

The APC chairman also said that he promised to maintain rule of law in the party and also uphold the voice of the members, adding that party supremacy must be respected.

A source privy to the goings on, said “I can tell you that there is an attempt by the disgruntled governors to rake in as many members of the National Executive Committee as possible, to force a meeting by NEC and pass a vote of no confidence in Oshiomhole. But I can also tell you that we have made our moves to counter that.

“As I speak to you right now, the entire South-South and South-East’s chairmen, who are members of NEC, are resolute that the attempt (by the governors) will not see the light of the day.

“You saw the last communique they issued the other time; the one from the South-South chairmen? I was the brain behind it. We have also done the same thing with the South-East. We have those zones – excluding Imo State in the South-East – locked down in support of Oshiomhole.

“In addition to that, we have also reached out to the majority of the chairmen in the North and the South-West. Apart from two states in the South-West – that is the chairmen of Ogun and Ondo – all others in the South-West are fully with us. In the North, the zone is being coordinated for us by the chairman of the chairmen, who is the Chairman of Borno State chapter. Apart from Zamfara, we have almost all other chairmen in the North.�

Oshiomhole has Buhari’s blessing

The source also told Punch that Oshiomhole enjoys the full support of President Buhari.

Citing the case of Okorocha and Amosun, the source wondered why the two Governors, after getting Senatorial tickets, also want to impose their Governorship candidates on the party.

“They know that they don’t have the backing of the Presidency. Anyhow you look at it, Oshiomhole enjoys the support of Mr. President (Muhammadu Buhari). The reason why some of us are resolute in our support for Oshiomhole is because although he is not a perfect man, he is trying to implement the promises that he made to all APC senators with a presidential backing; and getting them implemented, he has incurred the wrath of some of these governors who are not on the same page with the senators. It is the same with the House of Representatives.

“Now imagine someone like Senator Lanre Tejuoso (Ogun-Central). This is a man who has been loyal to Mr. President. When we needed him most, he was with us to prevent the veto and override of Mr. President, to ensure that Mr. President was not impeached.

“We also needed his vote and he gave his vote to us on the issue of elections sequence that was targeted at Mr. President, to take the president to the back of elections timetable. We had him supporting us. But now, all of a sudden, the guarantee he would have needed to return to the Senate, he is now deprived of,� the source added.

APC spokesman reacts

Speaking on the alleged moves to remove Oshiomhole, the APC National Publicity Secretary, Mallam Lanre Issa-Onilu said he is not aware of any plot.

Issa-Onilu also added that the ruling party’s internal issues will not be discussed in the media.

On the plans to convene and emergency meeting, the spokesman said “I am not aware of any plan to convene a NEC. There are procedures for doing such things, and to the best of my knowledge, the process has not been initiated.�

Other reactions

Also, a front-line supporter of Buhari, Senator Ovie Omo-Agege said any attempt to remove Oshimohole will be resisted.

He also said “Some of us are standing by Oshiomhole because he is standing by us. Majority of us have so far succeeded (in getting tickets) but a couple of them failed.

“Oshiomhole should know that he has the backing of the APC Senate Caucus at all times.�

On his part, the Majority Leader of the Senate, Senator Ahmad Lawan dismissed the reports, saying that the APC chairman’s removal will not solve the party’s problem.

“I don’t think there is any truth in it because disagreements are normal in political parties and organisations. And leadership requires that when there are disagreements, the parties involved come round a table and discuss to find a way forward.

“There are so many issues up for discussion and I don’t believe that there is any particular effort to just get the national chairman of the party removed because of the situation today. My instinct tells me that my party – a very progressive party – will not be going for that kind of thing, just removing the chairman because that will not address the issues.�
