Judgment doesn’t affect Magu

The recent judgment of the Federal High Court in Abuja by His Lordship, Justice J.T. Tsoho over confirmation of the appointment of the chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Magu by the Senate doesn’t affect the position of ‘acting chairman’. Unfortunately, the senate amplified the obiter dictum (statement by the way) in the judgment, ignoring the most important part which was dismissal of the suit over locus standi, thus, of no effect. In addition, there was no declaratory order by the court to remove the acting chairman from office.

Without a doubt, the Senate has unfettered powers as adumbrated by the court to confirm or reject President’s nominee from becoming a substantive chairman of the commission which gives statutory benefits. However, the senate cannot dictate to the President who to appoint in acting capacity, and clearly, the duration for acting position is not specified. By implication, the acting-chairman of the commission can remain in the position as long as the President desires.

Two persons decide the fate on mere ‘acting’ position; the President and the appointee. The business of the senate begins and ends with the confirmation or rejection of substantive position. As Magu is rejected for confirmation as substantive head, it implies President Muhammadu Buhari would come up with a new nominee ‘as soon as possible’. As long as the appointee is not bothered about the confirmation which offers statutory securities and benefits, no harm is done.

Incidentally, the senate relied on a report of the State Security Service (SSS) to refuse confirmation but forgot that pursuant to Section 36 of the 1999 Constitution of the Federal Republic of Nigeria, as amended, Ibrahim Magu is still presumed not guilty. Funnily enough, a good number of the senators and members of the House of Representatives have been, at one time or the other indicted through similar reports but on account of the presumption of innocence in the constitution, they contested election and were sworn in. The simple direction of the obiter dictum is that the senate confirms appointment for a substantive chairman. As for acting capacity, no confirmation is required by sole discretion of the President.

Politics: Maldives declares state of emergency, arrests 2 Supreme court judges and former president

The state of emergency was issued on Tuesday morning and will last 15 days.

The Maldives has entered a state of emergency.

President Abdulla Yameen made that declaration in the early hours of Tuesday morning local time, and in the hours since, two Supreme Court judges — of a total of four — have been arrested along with former president Maumoon Abdul Gayoom.

According to Reuters, the situation in the Indian Ocean nation began when the Supreme Court dismissed terrorism charges against nine opposition leaders, six of whom are being held in jail, but Yameen refused to comply.

The Ministry of Foreign Affairs has confirmed that, despite the declaration, there will be no curfew and that services and business "will not be affected."

There are also no restrictions on traveling to or from the popular holiday destination, and all transportation remains operational.

Ebonyi to distribute 400 tricycles to youths, women

ABAKALIKI—EBONYI State Government, yesterday said, it had put modalities in place to ensure the distribution of 400 tricycles to indigent youths and women across the state.

The Commissioner for Economic Empowerment and Job Creation, Barr Orji Uchenna Orji stated this while inspecting the tricycle assembly ground at the State Government House, Abakaliki.

Orji reiterated the commitment of the present administration towards enhancing the living standard of the people of the state through life changing empowerment programmes,adding that very soon,a group of youths / women would be sent to Lagos State to acquire skills on how to repair tricycles as the trainees would be empowered to own tricycle workshops in the State.

According to him, those nominated to benefit from the tricycle Empowerment Programmes would be exposed to training on international best practices on driving of tricycles, so as to reduce incessant cases of accident.

The GCCA will be led by international cement companies and headquarters to be based in London, complementing and supporting the work done by existing associations at national and regional levels.

House Intelligence Committee Democrats are gearing up to launch a retaliatory strike against the so-called Nunes memo.

  • The House Intelligence Committee voted unanimously to approve the release of a memo authored by ranking member Adam Schiff which disputes the key points in a rival memo by chairman Devin Nunes that was released last week.
  • The Democratic rebuttal is a "point by point refutation" of the Nunes memo that would "lay waste" to all of its central claims, a Democratic committee source said.
  • The Republican memo has been at the center of President Donald Trump's and his allies' efforts to discredit the ongoing Russia investigation.

The House Intelligence Committee on Monday voted unanimously to approve the release of a memo authored by ranking member Adam Schiff, which centers around the FBI and Department of Justice's application for a warrant to surveil former Trump campaign adviser Carter Page.

Schiff drafted his memo as a rebuttal to the Republican memo released by the committee last week, which purports to show that the FBI and Department of Justice (DOJ) abused their surveillance authority when they applied for the Page warrant.

In particular, the Republican document, which was authored by House Intelligence chairman Devin Nunes and his staff, said the DOJ relied primarily on what it characterized as insufficient and unreliable information contained in the Steele dossier when submitting the application for the Foreign Intelligence Surveillance Act (FISA) warrant for Page. The Steele dossier is an explosive collection of memos alleging collusion between the Trump campaign and Russia that was compiled by former British intelligence officer Christopher Steele.

The Nunes memo claims the FBI and DOJ omitted "material and relevant" information about the dossier's funding and origins from the FISA application. It also says former FBI Deputy Director Andrew McCabe said in his congressional testimony last year that the Page warrant would not have been sought without information in the dossier.

The Democratic memo focuses mainly on pushing back against the Nunes memo's characterization of McCabe's testimony and its claim that the dossier was the sole basis for the Page FISA application, two sources on the House Intelligence Committee told Business Insider.

It will also dispute Republican claims that the DOJ and FBI concealed critical information about the dossier's funding from the Foreign Intelligence Surveillance Court (FISC) when submitting the Page FISA application. Nunes conceded as much in an interview with "Fox & Friends," telling the hosts that the FBI included the dossier's political funding in a footnote when applying for the Page warrant.

Its production was originally financed by a group of Republicans who opposed Trump during the Republican primaries. After Trump became the party's nominee, Hillary Clinton's campaign and the Democratic National Committee hired the Perkins Coie law firm, which in turn retained the opposition-research firm Fusion GPS to fund the dossier's production.

The Democratic rebuttal will also shed light on the FBI's "pre-existing focus" on Page that was underway long before the DOJ applied for the warrant, one of the sources said.

The claim bolsters reports last week that Page had been on counterintelligence officials' radar since 2013 — more than three years before he joined the campaign.

In January 2013, according to Page's testimony before the House Intelligence Committee last year, he met Russian businessman Victor Podobnyy, a close ally of Russian President Vladimir Putin, at an event in New York. He met with Podobnyy a second time two months later, in March 2013.

That June, Page was interviewed by two FBI counterintelligence agents who were investigating whether Podobnyy and two others were Russian spies, according to court documents. When they started questioning him, Page reportedly told the agents their time would be better spent investigating the Boston Marathon bombing, which had occurred in April 2013. The FBI obtained its first FISA warrant to monitor Page that same year.

The Republican memo has been central to Trump's and his allies' claims that the Russia investigation, as well as the nation's top law enforcement agencies, are infected with anti-Trump bias and corruption.

While Republicans said the memo promoted transparency and held the government responsible, however, Democrats and intelligence officials said it contained a host of inaccuracies that painted an incomplete and misleading picture of the intelligence community, as well as the origins of the Page FISA warrant and the Russia probe.

The Democratic memo "is a factoral, point-by-point refutation of the Nunes memo" and "would lay waste to the idea that the investigation and FISA application for Page was based solely or even mainly on the Steele dossier, and also to the idea that the FISA court was not informed that the Steele dossier had been paid for with political motivations" said a Democratic committee source.

The memo will now go to Trump, who will have five days to review the document and either support its declassification or object to it.

The EFCC alleged that the money was stolen by a maritime firm named ZAL Marine Limited, through some employees of NIMASA.

An Abuja Federal High Court sitting in Lagos has ordered the final forfeiture of the sum of £578,080.00 to the Federal Government of Nigeria.

Justice Saliu Saidu ordered the final forfeiture, saying that the Economic and Financial Crimes Commission (EFCC) has proven that the funds were proceeds of unlawful activity.

In December 2017, the anti-graft agency filed an exparte application through its counsel, Rotimi Oyedepo, seeking the forfeiture of the funds.

Oyedepo argued that the money sought to be forfeited is reasonably suspected to be proceeds of unlawful activities of a maritime firm, ZAL Marine Limited.

He also alleged that the money was stolen by the maritime firm through some employees of the Nigeria Maritime Administration and Safety Agency (NIMASA).

The Commission accused one  Macfoy Irene, an Assistant Director and Head of Nigerian Seafarers Development Program,  to have facilitated the fraudulent transfer of the sum of £1,074,600.00 from NIMASA’s Zenith Bank (UK) Account to an offshore account belonging to Swiss Bulk carriers S.A under the false Pretenses of training 54 Nautical Science and Marine Engineering Students on Sea Training on 16th March, 2013.

The EFCC said the money was tranfered from NIMASA’s Accounts without any parastatal or Ministerial Tender Board Approval or Contract.

ZAL Marine Limited then allegedly received and retained the sum of £578,080.00 out of the transfer made to Swiss Bulk Carriers, S.A.

No state got stuck with a bigger bill than Indiana, but Minnesota was not far behind.

When it comes to paying for NFL stadiums, no state got stuck with a bigger bill than the citizens of Indiana and the construction of Lucas Oil Stadium, which opened in 2008. Of the $720 million cost, the city and state were responsible for about $620 million.

U.S. Bank Stadium, the home of Super Bowl LII, was not far behind.

The stadium was opened in 2016 at a cost of $1.061 billion. Of that, $498 million (48%) was paid for by the public, with $348 million coming from the state of Minnesota and $150 million coming from the city of Minneapolis.

At the other end of the spectrum, the Rams' new stadium in Inglewood and Meadowlands stadium, shared by the Jets and Giants, were both completely paid for with private funding.

In this graphic, produced by Reuters, we can see how the cost of building or doing major renovations at NFL stadiums varies wildly. But, despite a handful of exceptions, the vast majority of the stadiums had the vast majority of their financing come from taxpayers.

At the World Economic Forum recently, Salesforce CEO Marc Benioff drew a contentious analogy linking social media consumption to cigarette smoking.

Interviewer Andrew Ross Sorkin had asked Benioff how to regulate a company like Facebook, which has been fighting claims that the platform keeps people hooked and disseminates fake news. Benioff replied, "You'd do it exactly the same way you regulated the cigarette industry," since both products lead to addictive behavior and each is potentially harmful.

"Maybe there [are] all kinds of different forces trying to get you to do certain things," Benioff said. "There's a lot of parallels."

Digital technology is a modern necessity

According to psychology experts and tech executives working to curb tech addiction, Benioff's analogy falls short. Treating Facebook and other platforms like tobacco companies overlooks how vital smartphones and other digital technology are to everyday life, which complicates the way they can be regulated, these experts say.

Recent Pew surveys indicate that people use their online social networks to get information that helps them solve problems at work, connect with the right people, and ask work-related questions of people outside their organization.

While some people use Facebook to waste time, which we might think of as a digital smoke-break, the social network and its many peers — such as LinkedIn and Twitter — also enrich people's professional lives.

Gabe Zichermann, CEO of Onward, an app that helps people manage their tech use, wrote recently that social media is no longer just a time-waster at work.

"If their work involves engineering, marketing, sales, recruitment, or communications they need to be on social media during the day," argued Gabe Zichermann, CEO of Onward, an app that helps people manage their tech use, in a recent article. "And they would reject paternalistic efforts to reduce tech use."

Social-media use looks more like over-eating

Sherry Turkle, an MIT psychologist and author of " target="_blank"Alone Together: Why We Expect More From Technology and Less From Each Other," argues there's a closer analogy that should help solve the problem of tech overuse.

"I think it's much less like smoking and much more like eating," Turkle told Business Insider. "We have to eat, and people need to learn to make good food choices."

A crisis of tech addiction, in other words, looks more like the ongoing obesity epidemic. While rates of cigarette smoking have been on the decline in the US for several decades, obesity rates continue to grow. And just as major food corporations sell processed foods that are loaded with added sugar and chemicals meant to keep people eating, Turkle and other addiction experts say big tech companies have been repeatedly accused of designing their apps to maximize the time people spend on them.

Tristan Harris, a former design ethicist at Google, has seen the engineering tricks firsthand. Features like autoplay videos, endless scrolling, and gamification encourage constant use, Harris has said. They help explain how people may plan to watch just one YouTube video and glance at Twitter but somehow end up spending a half hour on both.

Turkle encourages people to seriously evaluate how much time they spend on devices, since it's not feasible to eliminate tech altogether. She believes it may also be necessary for governments to impose mandates in tech design that prevent kids from using tech without parental supervision.

"The way I like to put it is technology can make us forget what we know about life," she said. "One of the things it's made us forget is that we need to tend to our relationships and other people and our own feelings."

These are five things you should know about him.

1. Born to Nigerian parents

 

Full name Oluwadamilola Jonathan Ajayi, the NFL star is born to Nigerian parents. Born in London, Ajayi is a British citizen and fully identifies with it. He was seen carrying the British flag after the Super Bowl win.

2. Understands Yoruba

 

As much as he identifies with his country of birth, Ajayi still holds a lot of connection to Nigeria. He understands Yoruba, his parent’s original language and often puts the Nigerian flag on some of his posts on social media.

I definitely am very in tune with my Nigerian heritage,” Ajayi said in an interview.

 

Both my parents speak it fluently. And I understand it quite well as well. One thing about Nigerian people is that they are a very determined group of people. They are able to push through a lot of adversity and persevere through a lot of circumstances.”

3. He almost ended up a footballer

 

Ajayi was first introduced to football before American football by his father Ibe who once worked as a FIFA agent, had connections with a host of clubs in Europe and the Nigerian national team. His younger brother is a professional football player.

4. Arsenal fan

Born in London and a football lover Ajayi fell in love with Arsenal from an early age.

As soon as I came into the world, my dad wouldn't have let me live in the house if I wasn't an Arsenal fan!" he said in an interview with Arsenal TV.

5. Jail term

 

Before he became a successful professional NFL star, Ajayi was known for his off field troubles especially during his college days.

He was sentenced to five days in jail in October 2011 after he was arrested for shoplifting. He stole a pair of sweatpants at a local Walmart.

The University of Ibadan is currently the best higher education institution in Nigeria and here are five facts you should know about the first university.

The University of Ibadan was recently in the news again for being the best University in Nigeria.

The raking web in its January edition of university ranking rates the Premier University as the best in Nigeria based on web presence and impact.

Prior to the latest ranking, the 70-year-old institution has always made the top 10 African universities in Webometrics ranking.

This institution according to its Vice Chancellor, Prof Idowu Olayinka is the only school all Nigerians have attended either directly or indirectly.

''This is because if you did not attend UI, you must have been taught somewhere by someone who attended UI or who was taught by someone who trained in UI''.

However, the management of the university envisions it to become one of the top 100 in the world.

While this is the goal of the foremost higher education institution in Nigeria, here are five things you probably didn't know about the University of Ibadan.

1. The University of Ibadan popularly known as UI started with 104 students in 1948.

2. The first site of the university at Eleyele in Ibadan was previously used by the Military camp during the Second World War.

 

3. UI started with only three faculties which are Arts, Science, and Medicine

4. This institution is also the first Nigerian university to make the top 1000 in Times Higher Education rankings.

 

5. The University Library is named after the first Vice-Chancellor, Kenneth Dike, a Historian who left the University of Ibadan for Harvard during Civil War.

Apart from the  webometric ranking which acknowledges the institution as the best university in Nigeria, University of Ibadan has proved its worth as the first institution in the country.

Most of the first generation literary icons in Nigeria are graduates of this university. The likes of Wole Shoyinka, Chinua Achebe, Christopher Okigbo, Elechi Amadi, Niyi Osundare, JP Clark are all products of the University of Ibadan.

Agusi Oyeintari proudly showed off his wives in a picture posted on Facebook.

A picture posted on Facebook by a man named Agusi Oyeintari showed him happily sandwiched between his wives.

A polygamous man, Agusi Oyeintari, cut the reflection of a fulfilled man following a picture he shared of himself in company of two lovely wives who he seemed quite smitten about.

In a Facebook post he put up on Tuesday, December 26, 2017, Oyeintari thanked God for a successful union, expressing pride about having the women in his life.

 

One of his social media posts showed him sandwiched between his partners who also looked delighted in a picture.

He was captured with his hands on the belly of one of his wives who wore a blue blouse. The latter appeared pregnant based on a sighting of her protruded belly.

In other posts, Agusi Oyeintari was seen in images displaying his children, two boys and two girls. An expression of fulfillment lingered in the eyes of the daughters who were seen rocking the same outfit.

The boys, who struck a nice pose with their dad bore the look of those enjoying proper care from their parents as suggested by their well-fitted outfits.

Happiness in Oyeintari's polygamous family is not so common place in a Nigerian society that has offered open arms  when it concerns men having multiple wives.

 

This is because such association have often brought about rivalry resulting in malicious attack and even deaths.

Some men have however managed to maintain peace and less enmity between their partners by ensuring that they are equally satisfied.

Morocco were near-flawless hosts of the 2018 African Nations Championship (CHAN), which ended at the weekend, confirming they are creditable candidates to stage the 2026 World Cup.

FIFA member nations will this June select the kingdom or a Canada/Mexico/United States alliance to host the global football showpiece after Russia this year and Qatar in 2022.

The 2026 World Cup will be the first featuring 48 countries — up from the current 32 — and any serious slip-ups by Morocco in the 16-nation CHAN would have sent damaging signals.

However, apart from the decades-old African problem of luring crowds to fixtures not involving the host nation, Morocco emerged with flying colours.

Morocco could argue that the crowd-pulling appeal of home-based Africans, however talented, cannot be compared with world superstars like Lionel Messi, Neymar and Ronaldo.

“The organisation of this tournament has been exceptional,” Germany-born Rwanda coach Antoine Hey told AFP.

“Morocco has provided infrastructure that meets the highest international standards. I am extremely impressed.”

Libya goalkeeper and captain Mohamed Nashnush also hailed the organisation by Morocco, who are bidding a fifth time to host the World Cup.

“Morocco pulled out all the stops and the Libyan footballers, coaches and officials were very comfortable wherever they went in the country.

“The organisation and infrastructure were superb and I hope Morocco win the right to host the 2026 World Cup.”

Morocco national football federation head Fouzi Lekjaa, who is also a Confederation of African Football (CAF) vice-president, says his country has a compelling case.

“Since the first World Cup in 1930, Africa has organised the tournament only once,” he said, referring to the 2010 finals in South Africa.

Pre-CHAN tournament favourites Morocco whipped 10-man Nigeria 4-0 to win the competition, which has full international status despite being restricted to home-based footballers.

Their six matches attracted near-capacity crowds to the 65,000-capacity Stade Mohammed V in commercial capital Casablanca.

However, apart from the group game between Nigeria and Libya in northern city Tangiers, matches not involving the host nation drew paltry crowds.

Central city Marrakech and Agadir in the south on the Atlantic coast were the other venues used during the 23-day tournament.

Cold northern hemisphere winter weather was one deterrent to Moroccans with many who did attend wearing clothing more familiar with Europe than Africa.

An encouraging sign, though, was the number of families who came to watch some of the best domestic football talent in Africa.

Matches kicked off at 1630 and 1930 local/GMT time and many crowds decreased noticeably after the first game as temperatures dropped significantly.

Weather will not be an issue should Morocco be awarded the 2026 World Cup as the tournament is traditionally staged during June and July — hot months in the kingdom.

Morocco have not officially named their proposed World Cup venues, but the four CHAN stadiums are sure to be in the list.

At least one venue in capital city Rabat would certainly be included too.

An alleged sex tape of Tottenham midfielder Dele Alli has leaked on social media which sees him receiving fellatio from a girl.

The video emerged on Sunday, February 5 after he played 90 minutes in Tottenham’s 2-2 draw away at Liverpool.

In the sex tape, a guy who looks like the England international is seen standing naked while a girl performs oral on him.

 

There is laughter from the other people present in the room while the 21-year-old is seen grinning.

No word yet

The midfielder is yet to react to the alleged sex tape which has generated reactions on social media.

 

Tottenham have also not said anything about the tape.

 

The tape wasn’t the only controversy that trailed the midfielder as he was given the yellow card for diving in the Premier League clash on Sunday.

Alli has now developed a reputation for diving and notorious for his hot-head nesses.

Love is… Goodbye – the rebirth of hope and the dying of faith

I know I will love again

I knew you where a fighter and you are now living your life freely but with your old memories gone.

"She has just two days to live", the doctor said. His words sucked up from behind me and grabbed my throat.

By the hospital bed.

I was unable to cry because I was choked with my own fear. I stared at her and she smiled back, I was then overwhelmed with selfishness I wasn't ready to let her go.

I went over and sat down beside her, my eyes they met hers, and I saw the emotion in them that had been missing up to that point. Water welled up on the brim of her lids, gliding down her check in slow motion. I encouraged her to stay strong and fight, I knew all hope was lost but I wasn’t ready to feel her absence. She cried and beg for me to  move on but I love every bit of her. I held soulfully for the last time and I was willing to say Goodbye.

Letting go.

Goodbye to the times we stay up all night laughing at unnecessary things. Goodbye to your dream of becoming a artist. Goodbye to that perfect smile of yours. Goodbye to all the pains and numerous drugs you had to choke down, you can now rest well. Goodbye to all the silly things we do together. Goodbye to the endless video chats and messages. Goodbye to the countless moment, it was worth the while.

Goodbye to how you cry and that your funny noises. Goodbye to the times we sing along to your favorite song. Goodbye to all the birthdays and Christmas we had together. Goodbye to our dream of being together. Goodbye to the times when I stay all night just to watch you sleep. Goodbye to the imperfect you. I can never forget you for a single minute, didn't grow far from my heart , But in it.

 

"Am sorry", was all she whispered to me. I held her hand and watched her slip away from me forever. I didn't have any profound words, I just whispered, "Goodbye." I know I will love again, but nobody can replace you in my heart, so am going to carry you every where I go till we meet again.

Breathe again.

 Now its two weeks without you, surprisingly I heard you survived, I knew you where a fighter and you are now living your life freely but with your old memories gone. Well I can't wait to meet the new you. I tried sending you letters but I ended up with a blank page. It has been hard on me, I cried sometimes, I don't smile like I used to.

I came by your house today, I realized you where around, my heart beats faster. I clung to you but you shirked away and gave me that astonished look. And it brought back that ache that was deeply rooted and it throbbed into me. I tried shielding that pain but I was still held back. I showed you the memory we made together but your new memory bereaved you from understanding us. I had no choice than to move on.

This is goodbye for real.

I left
