US Government Preparing Potential Investigation Into Google Over Its Monopoly On Competition

The US Justice Department has taken early steps towards opening a federal antitrust investigation into Google, according to three people familiar with the matter, marking a new chapter in the tech giant’s troubles with regulators around the world who contend the company is too large and threatens rivals and consumers.

The move thrusts Google back under the regulatory microscope in the United States roughly six years after another federal agency probed the search and advertising behemoth on grounds that its business practices threatened competitors – though the government spared the company from major punishment at the time.

The exact focus of the Justice Department’s investigation is unclear.

The department began work on the matter after brokering an agreement with the government’s other antitrust agency, the Federal Trade Commission (FTC), to take the lead on antitrust oversight of Google, according to the people familiar with the matter, who spoke on the condition of anonymity because the deliberations are confidential.

The probe could threaten Google with a harsh examination of its sprawling digital empire, which includes its dominant position in search and advertising, its Android mobile operating system and newer gambits such as self-driving cars and drones.

Its expansive, data-hungry footprint increasingly has drawn the attention of Democrats and Republicans on Capitol Hill, who say that Google – and some of its peers in Silicon Valley – have become too large and should potentially be broken up.

The Department of Justice declined to comment, citing its policy against confirming or denying investigations.

The FTC did not respond to a request for comment. Google declined to comment. The news was first reported by the Wall Street Journal.

Some Democrats seeking the presidency in 2020, such as Senator Elizabeth Warren of Massachusetts, have explicitly threatened more oversight of the tech industry if they win the White House.

Google and other big tech companies “have too much power and they’re using that power to hurt small businesses, stifle innovation, and tilt the playing field against everyone else, Ms Warren said in a statement late on Friday. “It’s time to fight back.

The Trump administration has also studied Silicon Valley – the Justice Department convened state attorneys general last year to explore the competition concerns posed by Google and other big tech companies.

Some of those state attorneys general expressed their own interest in banding together and opening an antitrust investigation of Google at the time.

In Google’s previous tangle with antitrust regulators, FTC officials sought to determine whether the company’s search algorithms – and its practice of devoting better screen real estate to its services over those of rivals – threatened competitors.

The FTC also investigated Google’s advertising practices, as well as the means by which the company licensed to its rivals some of the critical patents involving mobile phones.

But the FTC opted in 2013 against forcing Google to alter broad aspects of its business, including the way it displays search results.

The agency also decided not to pursue a breakup of Google.

The decision by the agency, at the time under President Barack Obama, drew the ire of critics who felt the agency should have challenged Google in a way similar to when the government sued Microsoft in the 1990s in one of the last major US antitrust cases.

The government at the time alleged that Microsoft broke federal antitrust laws to protect its dominant operating system, Windows, and crush competitors.

In contrast, Google has faced greater antitrust scrutiny abroad.

The European Union has been a leading force in actions against the tech giant, and regulators there have imposed roughly $9bn (£7.12bn) in fines against the company in the past three years.

Those rulings include findings of violations of competition rules in the way Google presents search results.

EU rulings also faulted the company for how it licenses its Android smartphone operating system to device makers. EU officials also have threatened additional investigations and potential penalties, spurred on by allegations from some of Google’s competitors, such as the reviews site Yelp.

At the Justice Department, a full-fledged antitrust probe of Google could present another major test for an agency that has most recently been scrutinising the tech and telecom industries.

Last year, the department unsuccessfully challenged AT&T’s purchase of Time Warner, and in recent weeks, antitrust lawyers there have raised concerns about the proposed merger of Sprint and T-Mobile.

Makan Delrahim, who currently leads Justice’s antitrust division, is on his second tour of duty at the agency.

Mr Delrahim previously represented corporate clients including Google during its purchase of the ad giant DoubleClick in 2007.

Pope Braves Rain-Soaked Mountain Roads For Transylvania Mass

Pope Francis braved a rain-soaked, twisting drive through the mountains of Transylvania on Saturday to visit Romania’s most famous shrine, urging Romanian and ethnic Hungarian faithful to work together for their future.

Storms forced Francis to change his travel plans and add in a three-hour car ride through the Carpathian mountains that he had planned to traverse via helicopter. The steady rains doused the estimated 80,000-100,000 people who gathered for the Mass at the Sumuleu Ciuc shrine, which is dedicated to the Virgin Mary.

The showers let up as Francis arrived and he made a quick run through the poncho-clad crowds in his popemobile. But the 82-year-old seemed unsteady after the long trip and held onto the arms of aides as he negotiated a mud-slicked path to get to the altar for Mass.

In his homily, Francis praised the multicultural and multilingual tapestry that makes up Romania and urged its people to put aside past divisions for the sake of “journeying together.

The rights of around 1.2 million ethnic Hungarians who live in Romania have been at the center of political disputes between the two countries for decades. Hungary lost Transylvania in the peace treaties after World War I yet the region remains heavily Hungarian in both culture and language.

Those tensions are often reflected in the uneasy relationship between the predominantly Hungarian Roman Catholic community and the Romanian-speaking Greek-Catholic communities. The two rites make up Romania’s Catholic minority in the overwhelmingly Orthodox country.

“Complicated and sorrow-filled situations from the past must not be forgotten or denied, yet neither must they be an obstacle or an excuse standing in the way of our desire to live together as brothers and sisters, Francis said.

The pope delivered the homily in Italian, and it was translated into Romanian and Hungarian.

After Mass, with the weather improved, Francis was able to fly by helicopter back to the airport for a flight to another corner of Romania, the university city of Iasi in the northeast. There he had an appointment with young Romanians.

Francis was travelling across Romania to visit its far-flung Catholic communities to make up for the fact that St. John Paul II was only allowed to visit the capital, Bucharest, in 1999 in the first papal visit to a majority Orthodox country.

We Must Not Avert Our Eyes From Crisis In Idlib

In the past few weeks, the three million civilians trapped in the Syrian province of Idlib have been subjected to a savage bombardment from the skies. Buttressed by his Russian backers, Syrian President Bashar Al Assad claims he is attacking extremists, chiefly Hayat Tahrir Al Sham, who control the enclave. However, this is a more cynical campaign to conquer the final bastion of rebel control – and Mr Al Assad will not rest until it is decimated.

While there are extremist elements operating in Idlib after rebel fighters refused to hand over weapons, most of its population – including one million children – are innocent civilians, already battered by eight years of war. Millions were bussed there from other rebel enclaves and now find themselves in a holding pen. To understand the morally bankrupt Assad regime, consider reports that bombs are falling during iftar as long-suffering residents break their fast.

There are chilling parallels with Aleppo, which suffered a similar fate before it returned to regime control in 2016. In the bloody process, thousands were killed. In Idlib, schools and hospitals are thought to have been deliberately targeted, killing at least 160 and displacing more than 300,000 people, compounding what was already a humanitarian crisis.

Given that the fall of Idlib would effectively seal victory for Mr Al Assad in what has been an eight-year civil war, this campaign was both predictable and preventable. An all-out assault was previously thwarted by a Russia-Turkey-brokered ceasefire, which now appears to be crumbling. This is typical of the Syrian president, who has repeatedly employed a “starve or surrender policy. And yet, with Russia vetoing any action, the United Nations Security Council has proven itself incapable of alleviating the plight of Idlib’s besieged millions.

There has been a complete failure to protect the young and the helpless, despite empty promises of action from the international community when red lines are crossed. As Ursula Mueller, UN assistant secretary general for humanitarian affairs, said last week: “Is there nothing to be said or done when barrel bombs are indiscriminately dropped in civilian areas? The answer is clear in Idlib. The world has simply turned to look the other way.

The U.S. now wants to know the social-media user names of people applying for visas as part of stepped up screening of foreign visitors and immigrants.

World Leaders Set To Mark France D-Day Invasion,s 75th Anniversary

World leaders will gather in solemn assembly next week above the sandy beaches of Normandy to mark the 75th anniversary of the world-changing D-Day invasion of France. It’s typically a heartfelt tribute to alliance and sacrifice and a unified vow for enduring unity, outweighing any national or political skirmish of the moment.

In a report through stripes.com, that’s what has some U.S. veterans and others worried about President Donald Trump’s attendance. The president has shown a repeated willingness to inject nationalistic rhetoric and political partisanship into moments once aimed at unity. For Trump, there is no water’s edge for politics, no veneer of non partisanship around military or national security matters.

The president, who did not serve in the military before becoming commander in chief, has feuded with Gold Star families, has blasted political opponents on foreign soil, and mocked Sen. John McCain, a prisoner of war, for being captured by the enemy. Trump’s antipathy for the late senator was so well known that the White House this week requested that the Navy keep the USS McCain out of the president’s line of sight during a recent trip to Japan so as not to rile the president.

It’s a pattern that is set to get more scrutiny in coming days, as Trump heads overseas for the D-Day memorial, where he will be joined at the service by, among others, House Speaker Nancy Pelosi, a Democrat whom he has called “crazy Nancy and has warned not to try to impeach him.

“It’s unfortunate we have to be even concerned that this historic commemoration will be overly politicized, but this is the command climate he’s created and the reality we have, said Paul Rieckhoff, founder and former head of the Iraq and Afghanistan Veterans of America and now host of the podcast “Angry Americans. “We have to send our president. You go with the president we’ve got, and this is the president we’ve got. So we’re rightfully holding our breath for an event like this.

More than 9,000 Americans are buried in the cemeteries dedicated to the D-Day operation that marked a turning point in World War II, beginning the Allied push to drive the Nazis out of France and eventually Europe. On a bluff overlooking Omaha Beach, rows of white crosses and the Stars of David stretch as far as the eye can see — markers of sacrifices.

The president missed the other significant military commemoration of his term.

In November, also in France, Trump scuttled plans to honor the 100th anniversary of the end of World War I at Aisne-Marne American Cemetery. The White House said the president’s helicopter could not make it to the site because of bad weather. It did not explain why Trump could not make the 50-mile drive. His absence set off howls from many veterans.

Honeywell Defeats Ecobank In Final Judgement

The Honeywell Group recently emerged victorious in its protracted legal dispute against Ecobank with the judgement delivered by the Federal High Court, Lagos in which the court held that Honeywell’s payment of N3.5 Billion between 2013 and 2014 constitutes the full and final settlement of its indebtedness to Ecobank Nigeria Limited.

In a report through brandafriq.com, according to the judgement delivered by Justice Olayinka Faji, a valid agreement was reached at various meetings between representatives of Honeywell and Ecobank on the 22nd of July, 2013 and in line with this agreement, Honeywell made payments to the Bank in order to settle its indebtedness. However same could not be said of Ecobank who rather than keep to the terms of the Agreement, sought to introduce new terms.

The court further held that all through the course of the instalmental payments being made by Honeywell, Ecobank did not at any time raise any objections to the payments. The amount now being claimed by the bank was not at any time mentioned in the meetings or series of correspondence with Honeywell.

It will be recalled that Anchorage Leisures Ltd, Honeywell Flour Mills Plc. and Siloam Global Limited (all members of the Honeywell Group), in August 2015, instituted a suit before the Federal High Court, Lagos seeking the determination of whether or not the companies are truly indebted to the bank following the payment of the sum of N3.5 billion as full and final settlement of their obligations to Ecobank, based on a mutual agreement between Honeywell and Ecobank.

Testifying in court during the trial, Honeywell Group’s Head of Treasury and Finance, Oluwakemi Owasanoye told the court that by an agreement reached at a meeting held on July 22, 2013, the bank agreed to merge the collective indebtedness of Honeywell’s three subsidiaries, which amounted to N3.5billion.

Owasanoye added that part of the agreement reached with the bank was that N500million must be paid immediately, while the balance of N3billion would be paid before the exit of the Central Bank of Nigeria (CBN) examiners from the bank. According to her testimony, Honeywell complied with the terms of the agreement, and thereafter wrote to inform the bank of its compliance and the need for the bank to formally discharge the company of any further obligation. She stated that the bank in its reply to the letter did not raise any objections. Honeywell, she said, was however surprised when the bank proceeded to demand for further payments in respect of the debt which had been fully liquidated for over a year.

She further stated in her testimony that when the dispute arose, the Company referred the matter to the Bankers’ Committee which resolved the matter in favour of Honeywell.

In his own testimony, Ecobank witness, Mr Elemi Agbor, Head of Corporate Communications of the bank, while being cross examined by Honeywell’s lawyer, Mr Olabode Olanipekun (SAN), insisted that the agreement for the payment was for a two-term payment only. He said the agreement stipulates that N500million must be paid that same day and the balance later. He was however unable to substantiate his assertion before the court.

The judgement of Justice Faji gives victory to Honeywell in the protracted legal tussle which commenced in 2015.
