World: Michigan state's defender led review of abuse

As reports against Dr. Lawrence G. Nassar flooded in a year ago, besieged officials at Michigan State University announced they had ordered an internal review. Overseeing it would be Patrick J. Fitzgerald

Five women have said in lawsuits that they reported sexual abuse by Nassar to university coaches, trainers or counselors as early as the late 1990s.

In 2014, a woman complained to the head of the university’s sports medicine clinic that Nassar had inappropriately touched her, prompting an earlier inquiry, not involving Fitzgerald, that concluded that his actions were “not of a sexual nature,” based on consultation with the doctor’s colleagues.

Yet just last month, Fitzgerald — whom the university portrayed as reviewing the Nassar cases even while he was defending Michigan State from lawsuits — wrote that no one at the university understood what Nassar was up to until the victims began going to the police in 2016.

While many in the community today wish that they had identified Nassar as a predator, we believe the evidence in this case will show that no one else at MSU knew that Nassar engaged in criminal behavior,” he wrote in a letter to the state’s attorney general, who had asked to see Fitzgerald’s report.

Fitzgerald added: There was no report.

As Michigan State finds itself under intense scrutiny for its handling of Nassar, critics of the university’s response, including lawyers for more than 100 victims, say they cannot understand how Michigan State officials did not take action years earlier. They question how the earlier complaints resulted in no apparent discipline.

And they accused the university of failing to conduct a top-to-bottom, truly independent investigation, settling instead for a review by a legal team that was also trying to protect Michigan State from any damage in the courts.

“Michigan State led the public to believe that there had been an independent investigation,” Tom Leonard, the Republican speaker of the Michigan House of Representatives, said Friday in an interview. “And then as we continued to dig into this, we found out it was not an independent investigation. It was an internal investigation to shield them from liability.”

Fitzgerald said Friday that his team had never been “engaged to produce a public report” on the Nassar case. He suggested that his team’s role had been misinterpreted by some. In fact, the initial contract between Michigan State and Fitzgerald’s firm makes no mention of carrying out an independent investigation or producing any report.

“We were engaged to provide counsel regarding anticipated litigation and to make sure that any internal reviews did not interfere with the two law enforcement inquiries underway,” he said, referring to criminal investigations that led to Nassar’s guilty plea and sentencing. “In the course of gathering facts for the representation, the team of attorneys and investigators has conducted approximately one hundred interviews and reviewed a large number of documents. Our work is still ongoing.”

Under the terms of the law firm’s contract, the lawyers were to defend the university in lawsuits, facilitate “cooperation” with law enforcement and provide “counseling on any internal reviews conducted to make sure they are carried out in a manner that will best assist the university’s response.”

Though some women say they told university employees about abuse years ago, Fitzgerald wrote in December that no one who knew Nassar believed he could be capable of such behavior. “It is clear that Nassar fooled everyone around him — patients, friends, colleagues and fellow doctors at MSU,” Fitzgerald wrote.

Over the months since they hired Fitzgerald, 57, and his team of lawyers, Michigan State officials have highlighted his review — sometimes noting Fitzgerald’s involvement by name — as a sign of the seriousness of their response. Lou Anna K. Simon, who resigned as president Wednesday, had portrayed the university’s review as a robust and “tireless effort” that would go on as long as needed. “Even as we examine — through both criminal investigations and a thorough internal review — how something so abhorrent happened here and went on for so long, we are taking action,” she said last April.

Nassar was sentenced to 40 to 175 years in prison Wednesday after days of wrenching testimony from more than 150 women who have accused him of molesting them while he was a doctor for Michigan State and the national gymnastics team. The president stepped down hours later.

By week’s end, Michigan State’s athletic director, Mark Hollis, had also resigned. And two outside agencies — the federal education department and the Michigan attorney general — had begun what the university’s critics hoped would be truly independent investigations into its handling of Nassar.

On Friday, Joel I. Ferguson, a Michigan State trustee, said he agreed with criticism that “we have the person who was defending us investigating us.”

“There was a conflict,” he added.

But Brian Breslin, the chairman of the board of trustees, said he had “every confidence” in Fitzgerald’s interviews and information. “He never developed a report and was never asked to,” he said.

Asked whether there was a conflict in employing the same person to both defend and review the institution, Breslin said he had no comment.

Michigan State was dealing with a public relations crisis and a growing number of lawsuits when it hired Fitzgerald, who as the U.S. attorney in Chicago had built a reputation as a meticulously prepared, unyielding foe of crooks.

Declaring that the corruption would “make Lincoln roll over in his grave,” Fitzgerald oversaw the prosecution of Rod R. Blagojevich, the idiosyncratic former governor of Illinois accused of trying to get something in exchange for an appointment to the U.S. Senate seat that Barack Obama vacated when he was elected president.

Fitzgerald drew national attention by getting a conviction in a CIA leak case against I. Lewis Libby Jr., the former chief of staff for then Vice President Dick Cheney. And he had worked on high-profile terrorism cases from New York, including the trials of four defendants in connection with the 1998 bombings of U.S. embassies in Kenya and Tanzania.

“As far as investigating something, there’s absolutely nobody better,” Sam Adam Jr., one of Blagojevich’s defense lawyers, said. “As a criminal defense attorney, I can tell you, he was so good at applying pressure to people.”

But Fitzgerald’s role in the Michigan State case is not as prosecutor. Since 2016, Michigan State’s trustees have paid him and his law firm, Skadden, Arps, along with other lawyers, to deal with the Nassar case and to respond to litigation against the school. The true scope and purpose of the lawyers’ internal review have become a matter of fierce debate in recent days, but the trustees last February said the lawyers’ role was to “represent the university in all aspects of this matter,” adding, “This representation will include conducting the factual review necessary to address the allegations being made and to assess Nassar’s former work at the university.”

A Michigan State contract with Fitzgerald’s firm included an hourly rate of up to $990. The ABC affiliate in Detroit reported this month that Fitzgerald’s firm has billed the university nearly $4.1 million.

“The public relations team at Michigan State gave the impression that he was going to do some sort of dispassionate, independent investigation, and that simply was not true,” said John C. Manly, a lawyer for more than 100 of the women who have sued or made claims against Michigan State.

Manly said no one from Michigan State or its legal team had sought to interview his clients about what had happened. Fitzgerald said his team took “affirmative steps” not to interview victims of the abuse because of ethics rules restricting contact with plaintiffs in civil cases.

Among the women suing are five who reported feeling uncomfortable or violated to coaches, trainers and counselors in the late 1990s and early 2000s.

One of the women, Larissa Boyce, said she was molested by Nassar for over two years, beginning at age 16, while training with Michigan State’s youth gymnastics program in 1997 and 1998. Boyce said she had told the women’s gymnastics coach at the time, Kathie Klages. But instead of helping, the coach explained to Boyce that she was probably “misunderstanding” the situation and implied that Boyce would get in trouble if she filed a more formal complaint, according to a lawsuit.

Another gymnast said she had also told Klages about abuse by Nassar around that time. Klages retired last year amid the scandal. Her lawyer declined to comment, citing the pending litigation.

Michigan State’s policies require all employees to promptly report any sexual misconduct they learn about involving a faculty member, staff member or student. But it is not clear that any of the people who heard the complaints in the late 1990s and early 2000s reported it to university administrators.

In a court motion two weeks ago seeking to dismiss the case against the university and its employees, including Klages, Michigan State said supervisors did not even know there were allegations against Nassar until 2014, when another woman complained to the head of the university’s sports medicine clinic, Jeff Kovan, that Nassar had massaged her breasts, buttocks and vaginal area.

In that case, an investigator consulted with three doctors and a certified athletic trainer, who backed Nassar’s explanation that his actions were medically appropriate to treat the patient’s pain. Each of the four had a connection to Nassar: One of the doctors studied under him and was a colleague and friend, the investigative report said; one had known him since 1988 and was a classmate and teaching colleague; one had known him since 1995, and he had treated her daughter; and the trainer worked regularly with Nassar in the training room, an average four hours a week for 17 years.

The university found that Nassar’s actions were appropriate and “not of a sexual nature.”

Nassar continued to molest patients, according to lawsuits, and even as late as August 2016, just before victims began to go public, some Michigan State employees told gymnasts that Nassar’s methods were appropriate. The employees also sternly warned gymnasts not to speak to the media, according to allegations in court filings.

Gov. David Umahi, made this disclosure in Abakaliki while receiving Prof. Isaac Adewole, the Minister of Health during his visit to the state to ascertain the situation report of the outbreak.

The Ebonyi Government, on Saturday, blamed the Federal Government for its poor response to the Lassa fever outbreak, which was reported in the state since Jan. 14.

Gov. David Umahi, made this disclosure in Abakaliki while receiving Prof. Isaac Adewole, the Minister of Health during his visit to the state to ascertain the situation report of the outbreak.

Umahi, who was represented by his deputy, Dr Kelechi Igwe, said that the minister came to the state after the disease had claimed several lives, especially medical personnel.

We are not happy over the development and have declared the outbreak of the disease in the state, even if other affected states have not done that.

“We know that accessing money from the Federal Government is not easy but we want the health minister to redouble his efforts to ensure that funds and other logistics are released promptly to check such outbreaks.

He called for the equipping of the south east virology centre, constructed by the State government and handed over to the Federal Government in 2016.

We thought that the  government should have made the centre operational to make it respond to such outbreaks, as it serves states in South East and neighbouring ones as Benue, Cross River and Akwa Ibom,” he said.

He called on the Federal Government to release a stabilisation fund to enhance the centre’s operations, adding that the state government had bought a dialysis and a PCR machine for greater efficiency of the centre.

“We recorded 16 cases, nine confirmed cases, six suspected cases, one probable index case; eight persons admitted at the virology centre, one admitted in Irrua, Edo.

“There were four deaths, including two doctors and a nurse and three patients discharged from admissions,” he said.

Adewole, after inspecting the virology, said that the ministry was not informed about the outbreak of the disease on time.

We reacted accordingly immediately we learnt of the outbreak, as the government’s duty is to support states and we expect them to be in a position to respond accordingly.

“We only come to their rescue when the situation is beyond them because there is a Commissioner of Health on ground; this makes us  offer only additional support.

“We are not supposed to take care of the states’ health care, as I have seen patients and staff at the virology centre, we have noted the gaps and would fill in the gaps accordingly,” he said.

Adewole promised that the Federal Government would provide more facilities to the centre in the coming weeks to ensure that it caters for other diseases beyond Lassa fever.

We are not happy whenever we lose health personnel to diseases such as Lassa fever, as we expect them to protect themselves and be preventive-minded by viewing related-symptoms cases firstly, as Lassa fever”.

The chairman of APC in Benue state, also alleged that the defence minister is working for the Peoples Democratic Party (PDP).

Members of the Benue  state chapter of the All Progressives Congress (APC) have condemned the minister of defence, Mansur Dan-Ali for reportedly describing the Benue attacks as a communal clash.

Dani-Ali had earlier blamed the clashes on the anti-grazing law passed by the Benue state government.

In their reaction, the Benue APC members said the defence minister is a disgrace to democracy.

According to Daily Post, the Chairman of the party in the state, Abba Yaro also accused Dan-Ali of supporting the herdsmen.

The chairman also issued a statement saying “The Benue State Working Committee of our great party, All Progressives Congress led by the Chairman, Hon. Prince Emmanuel Abba Yaro, hereby states categorically that we read with utmost disgust the frivolous statement credited to the ‘supposed honourable’ Minister of Defence, Col. Mansur Muhammad Dan Ali where he reportedly told Nigerians and other members of the public that the attack on two communities in Benue that led to the death of over 70 innocent people and destruction of properties worth millions of Naira was as a result of the open grazing prohibition law enacted by the State Government.

“While we are still bewildered if the said statement truly emanated from the Zamfara born retired Military Colonel serving as our ‘supposed Defence Minister’, we consider this statement as a flatly ridiculous absurdity, and the highest level of public disgrace to democracy and the Nigerian populace.

“By this singular utterance, the Minister of Defence, Col. Muhammad Mansur Dan Ali (rtd) has inarguably displayed incontestable lack of the required sensibility and capacity to serve as Defence Minister in a country of over 180 million people with over 300 ethnic nationalities.

“We have therefore been constrained to believe that Mr. Mansur is a component unit of the perceived conspiracy against the good and hospitably peace loving people of Benue State.

“As an integral part of the country, Nigeria and as a State that gave President Muhammadu Buhari an edge in the 2015 general elections, we demand that Col. Mansur Dan Ali (rtd) resigns his position as Nigeria’s Defence Minister immediately and tender an unreserved apology to the good people of Benue State and the country at large.

“In as much as we would not dignify Col. Mansur with obnoxious affronts, we would again want to inform him that he is not just an ingrate, but an unrepentant pathological opportunist who was in his farm working for the PDP when many of us toiled the nooks and crannies of this country to ensure victory for President Muhammadu Buhari in the election that brought him (Buhari) to power through which he (Mansur) is one of the biggest beneficiaries.

“As someone who read Photography in the polytechnic and later took to animal husbandry with flocks of cows to his credit in his Zamfara country home, we urge our President, Muhammadu Buhari GCFR, to aid Col. Mansur’s timely resignation and return him to his farm with a Xenon HD Camera to continue taking snapshots of his flock of herds back home.

Governor Nyesom Wike of Rivers state also condemned the Minister of Defence, Mansur Dan-Ali over his comments on the Fulani herdsmen crisis in Benue state.

The Rivers state Governor also said that the minister displayed a high level of insensitivity.

To find out which Netflix original films are worth watching, we turned to Rotten Tomatoes to rank the likes of "Mudbound" and the Will Smith-led "Bright."

As Netflix will be releasing 80 new original films over the course of 2018, it's worthwhile to take stock of all that the service currently offers.

While the company's first entry into the realm of big-budget films, the Will Smith-led "Bright," has been scorched by critics, Netflix CEO Reed Hastings has hailed the fantasy-action thriller as a commercial success that critics are "disconnected" from.

On the opposite end of the critical spectrum, Dee Rees' period drama "Mudbound" recently earned the company four Oscar nominations in a record haul that appears to have legitimized Netflix as an awards season contender for feature films.

To figure out which Netflix original films are actually worth watching, we turned to the reviews aggregator Rotten Tomatoes to rank each release by its composite critical reception. We excluded documentaries and any film that didn't have enough reviews to receive a designation of "Rotten" or "Fresh," and we used audience scores to break ties.

Onyemaechi foundation, NGO gives scholarship to Little Nkemjika Nwankwo

In a bid to support human development and alleviate poverty in the country, Onyemaechi foundation, a non-governmental organisation has given a scholarship award to Miss Nkemjika Nwankwo, a primary one student of Model Innovative School, for distinguishing herself academically from her classmates.

‘Onyemaechi Hope for the hopeless Foundation’ was established as a non-profit and charitable organisation by Mr. Onyemaechi Okenwa Kennedy, the Executive Director of the foundation in order to assist people who cannot afford to train themselves and achieve their desired goals.

Little Nkemjika who bagged a scholarship award at Model Innovative School of Today Obosi, had her mother, Mrs. Ebele Nwankwo, in the same school as a teacher.

Report has it that the beneficiary of this glorious scholarship hails from Umuchukwu Orumba South Local Government of Anambra State.

Presenting the scholarship award cheque, the Coordinator of the Foundation, Mr. Okenwa Kennedy Onyema opined “My vision for this foundation is to provide help and succor to the less privilege, especially the widows, indigent youths and vulnerable children in the society”.

Speaking further he said “I call on other foundations to have their values as Onyemaechi Hope for the Helpless Foundation which include; love, compassion, partnership, teamwork, integrity and accountability in order to help our country, Nigeria.

“Onyemaechi Foundation has a highly inspirational programme that brings out the usefulness in human beings”, he said.

In her own address, Mrs. Nwafor Fidelia, the Headmistress of Model Innovative School of Today Obosi, who represented Dr. and Mrs. Obi Okoye, the Proprietor of the school lauded Onyemaechi Foundation for his kind gesture and zeal to change the life styles of individuals who cannot afford to help themselves.

In her words “Onyemaechi Foundation is geared towards inculcating into the poor youths, poor children and poor widows a complete knowledge and skills that will enable them to discover and utilize their God-given potential and appreciate the fact that God is an indispensable factor in our success formula”, she said.

Similarly, Mrs. Ebere Nwankwo thanked Onyemaechi Hope for the Helpless for remembering her family and urged governments and individuals in union with Chief Benedict. C. Adamaechi, retired Educationist to collaborate with the foundation to ensure that poverty is reduced if not eradicated from the country. They equally subscribed to what they call ‘3H approach’, meaning Head, Heart and Hands in order to equip and operationalize guidance and counseling in schools and ensure that from early in the pupils/students lives they are well guided on career paths.

The Federal Road Safety Corps (FRSC) has issued a travel advisory to motorists in states around Osun State as its local government elections get underway.

“Motorists are not allowed into any town within Osun, and are advised to use alternative routes to their various destinations.

“Those from Ibadan end to Akure can still use the usual route of Gbongan, Ile Ife, Ilesa, Ipetu-Ijesa, Akure as there will not be any restrictions whatsoever.

“The same route is advised to be used by motorists going to Ondo town as they will not be allowed into Ile-Ife town en route to Ondo.”

Kazeem advised motorists going to Ilorin from Akure axis to access Ekiti.

He urged them to exercise some patience till 3 p.m. when the election would have been concluded and normal traffic restored.

Mr Segun Oladitan, the Chairman of Osun Independent Electoral Commission (OSIEC) on Saturday said the low turnout at some polling units at the ongoing local government election was due to some misinformation by oppositions.

Oladitan while speaking with newsmen at the OSIEC Secretariat in Osogbo said he was surprised at the reports of low turnout in some polling stations.

He blamed the low turnout to some misinformation being spread by those opposing the election in the state.

He said described the oppositions as “mischief makers’’ saying they had been going around to tell the people that election would not hold.

Oladitan said it was falsehood from the distracters who claimed there was a court order restricting OSIEC from conducting the election.

He expressed delight however that new information reaching him indicated that the electorate were now turning out to vote.

Oladitan said the commission did a lot of sensitisation about the election, which resulted in large turnout of voters in some areas of the state.

On the late arrival of election materials, he said logistics and  human factor were responsible for the late arrival.

“But the fact that election materials arrived at their scheduled destination at by 9a.m. was a reasonable time,’’ he said.

Which Way Nigeria? Nigerian leaders have got a huge appetite

Let's vote wisely.

The responsibility of our leaders is to thrive to rise from mediocrity to competence and from failure to achievements.

The currents in some rivers is so strong that it makes them useless to navigate. Same goes for our leaders, who are filled with a huge appetite for greed and selfishness.

Nigeria we hail thee!

We have prayed, argued,protested, cursed and kept quiet whenever the matter of the country arises. As children, we were taught that our country would protect us, make education available and jobs would be created. As we grew,  we found out that there were no jobs and you need to be connected to get one.

Our problem in Nigeria is derived from not being able to advance beyond the stature of the leaders what in the past. When Nigeria became independent in 1960, citizens thought that was the end of the journey, when in fact, it should have been the beginning. For independence was granted for the country to be better United.

 

The responsibility of our leaders is to strive to rise from mediocrity to competence and from failure to achievements. But every year just seems the same as there are no improvement in any of the sector. Sometimes, we tend to ask if our leaders tasks themselves to becoming better in their duties, rather than device new skills in looting public fund without working.

The education sector is getting clumsy every year. Are the leaders discouraging education or what? Then we have the battle of Religion here and there, Fulani herdsmen and their most prized possession (cattles).  Telecommunications ripping us of our little money in the name of new tariff plan. Hike in price of fuel and kerosene has become the new way to end the year and resume with it in the new year. It's time we get automobiles and generators that would work with charcoal or sand.

People dedicate January to making goals, discarding old habits and improve resolutions. While our leaders take us back to our long suffering. Reminding us that we haven't improved not just yet, and it isn't happening any time soon. Oh yes! Our leaders love to shine. We cannot dispute that fact. There is the struggle that going on as to who is the greatest, who would get the first rank and so on.

Elections

As every four years,  there is a struggle as to who would become president. Yet only one man can get the prize of becoming president. My people choose wisely this time around so that the leaders chosen won't get misled and made believe to enjoy himself while on seat rather than to recognize service and learn to say "thank you" to loyal servants.  The internal foes of this country has eaten deep into their veins that their huge appetite for selfishness and greed cannot be easily removed. They have no time for meditation. They bask in the glory of their stolen loots, claiming their position is a peculiar one,while the mass cry woes of hardship

The fact still remains that we need a government stable enough to remain master of its own, resourceful enough to increase economic growth and just enough to protect the citizen from the crushing weight of officialdom.

Badaru also disowned and disassociated himself from a group supporting him to run for the office of President in the 2019 general elections.

The governor made his position known in a statement issued on Saturday in Dutse by his media aide, Malam Bello Zaki.

“The attention of the Jigawa State Government has been drawn to a mischievous paid newspaper advertisement purported to have been made by a faceless and unknown organisation called

`Muhammadu Badaru Abubakar for President Support Group’, which purportedly aimed its support to the recent comments by former President Obsanjo.

“The State Government hereby calls on the general public to dismiss and ignore the false and malicious advertisement and the message and evil innuendo it intends to propagate”.

The governor said that he neither have nor endorsed any organisation or group for the purpose of vying for any national office.

“Governor Badaru Abubakar does not have and does not endorse any organisation for the purpose of achieving or vying for any national office as he grapples with the challenges of governing his state and delivering on the mandate given to him by the Jigawa electorate.

“We understand that there are persons within and outside the state that perceive the cordial and progressive relationship that exists between the Governor and the Presidency as inimical to their personal and political interests and aspirations, especially in the light of several national assignments that the Governor is successfully carrying out at the behest of the President and Commander in Chief of the Armed Forces.

“We are working with the newspaper that carried the obnoxious advertising with a view to identifying the miscreants behind its publication and will use all available legal avenues to ensure that they pay for this dastardly attempt at souring the relationship between the State and the National Government,” it said.

The governor, therefore, urged the general public to ignore this and any future attempt to disparage the office of the governor using cheap and unimaginative media distortion.

The government also advised media organisations to place professionalism above commercial considerations.

It enjoined the media to utilise industry best practice and guidelines in determining the identity of persons and entities before publishing or broadcasting political and potentially controversial contents in the interest of national peace, stability and progress.
